Terms and Conditions

A booking request is an offer to book; it becomes a confirmed reservation only after we approve it and you complete payment through our payment processor (Stripe). Rates, fees, taxes, and cancellation terms are shown at booking and may be governed by an additional rental agreement.

• You must be at least 21 years old to book a stay.
• You agree to abide by the property's house rules, the rental agreement, and applicable law.
• You are responsible for the conduct of all guests in your party.

We use a third‑party provider (Twilio) to send SMS and MMS messages on our behalf solely for communication and notification purposes related to your bookings and account. By providing your phone number, you consent to receive SMS/MMS messages from Searko Retreats, including booking confirmations, payment notices, stay reminders, check‑in instructions, access codes timing, and replies from our team.

Message frequency varies and depends on your booking activity. Message and data rates may apply.

You can opt out of non‑essential SMS at any time by replying STOP. Reply HELP for assistance. Critical transactional messages related to an active booking may still be sent when reasonably necessary, subject to applicable law and Twilio's acceptable use policies. We do not sell or rent your phone number. See our Privacy Policy for details.

Cancellation and refund policies are described at the time of booking and in your rental agreement. Once accepted, they form part of these Terms.

You agree not to:

• Use the site or communications in any unlawful, abusive, or harmful way.
• Attempt to access systems or data you are not authorized to access.
• Submit false, misleading, or fraudulent booking information.

The site and services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee uninterrupted or error‑free operation of the site or message delivery.

To the maximum extent permitted by law, Searko Retreats and its affiliates, hosts, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the site, the services, or any booking.

You agree to indemnify and hold Searko Retreats harmless from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the site or services.

These Terms are governed by the laws of the State of Indiana, USA, without regard to its conflict‑of‑laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Indiana for any dispute that is not otherwise subject to arbitration or informal resolution.

We may update these Terms from time to time. Updated Terms become effective when posted. Your continued use of the site means you accept the updated Terms.
